J&K High Court Orders Day-to-Day UAPA Trials Under NIA Act Section 19

The High Court of Jammu & Kashmir and Ladakh has mandated that trials under the Unlawful Activities (Prevention) Act must proceed on a day-to-day basis. Citing Section 19 of the NIA Act, the court directed that these cases, including one pending since 2020, take precedence over other matters to prevent indefinite judicial delays.

Judicial proceedings for serious security offenses have frequently stalled in trial courts, resulting in long-term detention before trial completion. The J&K and Ladakh High Court intervened to enforce the statutory directive within the NIA Act, 2008. Section 19 specifically requires that once a trial begins, it must continue daily, prioritizing the case until a verdict is reached.

By invoking this section, the court affirmed that the mandate for a speedy trial applies even in cases involving stringent anti-terror legislation. The directive serves as a reminder to lower courts that procedural inaction cannot justify keeping individuals incarcerated indefinitely. The court specifically ordered the swift conclusion of a case that has languished since 2020.
