The High Court of Jammu & Kashmir and Ladakh has officially notified the new rules and guidelines regulating the designation of advocates as Senior Advocates. The rules, formulated under the powers conferred by Section 34(1) read with Section 16(2) of the Advocates Act, 1961, establish a rigorous and transparent evaluation system for conferring senior status.

Eligibility Criteria for Senior Designation

To be eligible for consideration for designation as a Senior Advocate, an advocate must satisfy the following minimum requirements:

  • Practice Experience: Must have at least 10 years of active practice as an advocate.
  • Age Limit: Must have attained the age of 45 years at the time of application or proposal.
  • Standing: Must be enrolled with the Bar Council of Jammu & Kashmir and Ladakh.

Point-Based Evaluation System

The selection committee will assess candidates based on a 100-point scale distributed across the following parameters:

  1. Standing and Practice (20 Points): Based on the number of years of practice, standing, and type of cases handled.
  2. Publications & Legal Writing (15 Points): Points awarded for articles, books, and contributions to legal journals.
  3. Judgments and Reported Cases (40 Points): Assessment of reported and unreported judgments where the advocate has argued significant legal issues.
  4. Personality and Interview (25 Points): Interaction with the Committee to evaluate overall suitability.
